A 49 year old grandmother who was accompanied by her husband, her 71 year old mother-in-law as well as a 13 year old grandson were allegedly assaulted over an incident involving french fries. The local media has been reporting that this incident was precipitated after the assailant thought the grandmother had taken her fries, but in a post on social media in an attempt to set the record straight the victim said that was not the case. We are publishing the victim’s statement in an attempt to report her account of the events unfiltered and unaltered.

The assailant was also allegedly assisted by some of her own children according to her statement below by the victim Elaine Modena. The decision to set the record straight on Facebook was also because two local newscasters named Frank Malloy and Ben Jones reportedly laughed about this incident. They work for local CBS affiliate 13WMAZ in Macon, GA. Given the surgery required for the eye injury to her husband, bruises, and the trauma suffered by her 13 year old grandson after being chased.around the car… I can certainly understand why she did not feel this was a laughing matter.

I wonder if Frank Malloy would think it quite so comical if people made jokes about his wife’s DUI  in August last year after a one-car crash in north Macon on June 2 left her seriously hurt. Lab results, according to her arrest warrant, showed that her blood-alcohol level registered 0.333, more than four times the legal limit before she ran off the road and hit a tree.

In the statement below it appears the assailant attacked the woman due to perceiving the bag had been snatched out of the hand of her niece who worked at Wendy’s. What I also found more troubling is the allegation that the Wendy’s employees with the exception of the manager allegedly followed the woman outside to watch this brutal attack while cheering it on. One of the employees also seemed to know the name of the attacker. The manager reported they only watched from inside and did not go outside.

Let’s hope Wendy’s corporate takes this attack more seriously than the local franchise. Let’s also hope local newscasters learn not to throw stones while living in glass houses and don’t use aggravated assaults as comedy fodder in the future.

The statement below is directly from the victim Elaine Modena from a Facebook post.

There is no reason for me to lie. I just hate how the facts were not said or written about the first time, or second time. This happened at the entrance to Wendy’s on the drive thru side. If the whole order was given in the first place, I would not have been asked to pull up and told they would bring me the rest of the order out in a min. If the employees or employee would have brought them out, I would not of went into Wendy’s. When I went into Wendy’s, I was ignored at the counter, when they finally handed me the bag I turned around and left. The woman had her order and was talking to the staff. She accused me of snatching the bag out of her Niece’s hand. I did not even know she had followed me until she started banging on my window. The whole staff except the managers ran outside and was cheering her on calling her by name. They may not be trained to break up an altercation, but they should be trained or have enough sense to dial 911. When the general manager was called, he saI’d he had not heard about it and would look into and would call us back. When he did not call back , the district manager was called, he said he would look into and call back. When he did not call back, I called him he said to get a lawyer. To me that is not professional. Then when channel 13 first airs the story, which I did not see or know about, I was told Frank Malloy and Ben Jones were laughing about it. It is not funny, it was a nightmare. It still is a nightmare. My husband has to have surgery on his eye from being hit while trying to get that woman off me. She grabbed my hair with one hand punched me in the face with the other. After my husband got me in the car, she opened my door and hit me again. This is not funny, and not a joke when my 13 year old was chased by one of her kids, and traumatized. My Grandson and I both have NEVER in a million years would have thought this would happen by driving thru Wendy’s for a to go order. It is no funny I had a black and blue eye and forehead. It is not funny my husband has to have eye surgery. It is not funny that a new car that had not even been in my possession long enough to make the first cr Payment has a dent in it. Ithe is not funny that now I am scared and afraid to go out to the movie or that area at night. This whole thing still has me in shock. No I cannot let it go when it bothers me and scares me. I do not have a lawyer to contact Wendy’s lawyer. I guess I need one now…………

Request For Public’s Assistance Locating Person of Interest

Wendys 3 jpegThe Bibb County Sheriff’s Office is asking for the public’s assistance in identifying a person of interest. Bibb County Sheriff’s Investigators would like to talk with the female in reference to an assault that occurred at Wendy’s Restaurant, located at 6040 Zebulon Road, on Saturday February 13, 2016 just before 10:30PM.

The individual is described as a black female. She was wearing a brown jacket, light colored shirt and pants with brown boots the night of the incident.

Photographs of the female are attached.

Anyone with information on the identity or whereabouts of the female, or has information about the incident is urged to call the Bibb County Sheriff’s Office at 478-751-7500, or Macon Regional Crimestoppers at 1-877-68CRIME.

  1. This country is getting more intolerant as violence escalates everywhere in the U.S. And when we have would be presidents who commend violence against others, we know we have a big problem. Hate is the new love in the USA.
    It will only get worse, because of denial of climate change, work migration, the teaching of the far right.
